Samsung Galaxy Galaxy S22, Galaxy S21 FE, Galaxy S23, S23 + or S23 Ultra (“PROMOTION”)
TERMS AND CONDITIONS

Participants agree to be bound by these terms and conditions (the “Terms and Conditions”). Any information or instructions published by the Promoter about the Promotion at https://recycle.exertis.co.uk form part of the Terms and Conditions.

The Promoter
1. The Promoter is Exertis (UK) Limited, Technology House, Magnesium Way, Hapton, Burnley, BB12 7BF (the “Promoter”).

Promotion Period
2. The Promotion will commence at 00:01 on 12 July 2023 (GMT) and shall close at 23.59 (GMT) on 7 November2023 (the “Promotion Period”).

Eligibility
3. To be eligible to participate in the Promotion you must be a Company registered in the United Kingdom, Channel Islands or Isle of Man (“Participant”).
4. Employees or agents of the Promoter that are involved in the operation of this Promotion or anyone professionally connected to this Promotion are not eligible to enter.
5. Network providers, retailers, distributors, resellers and any person who purchases the Promotion Products (defined below) for resale or otherwise not as the user of the Promotion Products, may not participate in this Promotion and are specifically excluded as a Participant.

Offer
6. Participants who order a new (i.e. not second hand or ex-display) Samsung Galaxy S22, Galaxy S21 FE, S23, S23+ or S23 Ultra device from the list in the table below, (“Promotion Products”) online from resellers Daisy Communications, Aerial Direct , Onecom, Voice Mobile, Kit Online, Computacenter:(“Participating Reseller”) during the Promotion Period and who trade in any smartphone (save only for smartphones which fall within the exclusions set out in term 9 below) (“Trade In Device”) will be entitled to claim a total of £100 (Galaxy S22, S21 FE, S23, S23+) or £150 (S23 Ultra) reward (paid by way of bank transfer) by redemption (each a “Reward”).

7. If a device is not included on the list of eligible devices, Participants will be entitled to claim a £100 or £150 reward by selecting the “Any other Android handset” or “Any other Apple handset” to complete their claim. If there are any issues Participants may contact MTR on the following site where the claim will be managed: https://recycle.exertis.co.uk

8. Purchases from auction websites (e.g. eBay) or from third party sellers on online retailers’ websites are specifically excluded from this Promotion.

9. Any Trade In Device(s) used to Claim in this Promotion must be owned by the Participant making the claim, and must not be stolen. Where the device(s) can be switched on, it must not be PIN locked or have an Activation Lock or iCloud Lock applied. Devices that are Jail Broken or which have altered firmware will be treated as non-working devices.

10. Participants may submit a maximum of ten (10) claims per Company Participant.

11. Rewards are non-transferable. In the event of unforeseen circumstances, the Promoter may substitute a Reward of equal or greater value for the Reward.

Claims
To claim, Participants must first purchase a Promotion Product(s) during the Promotion Period then visit the website below which corresponds to their Participating Reseller:

Participants must then enter the IMEI or serial number(s) of the Promotion Product(s) purchased and the IMEI or serial number(s) of their Trade In Device(s), and complete the online claim form including the provision of bank account details (“Claim”).

12. Claims must be made within 14 days of receipt of the Promotional Period. No claims may be made after 23:59 (GMT) on 21 November 2023 (the “End Date”). Claims received after this time will be marked as invalid and will not be accepted.

13. Company Participants must send their Trade in Devices to Exertis Trade in for Business using the address label provided within the confirmation email. Company Participants will be required to pay for postage of their Trade in Device.

14. Within 72 hours of the Promoter receiving the Trade In devises, the Promoter will validate proof of purchase with the Participating Reseller and then send an email to confirm whether the Claim has been successful and validated.

15. Delivery of the Reward will be by bank transfer to the UK bank account provided in the Claim.

16. Claims which are incomplete or damaged will be deemed to be invalid. No responsibility is accepted by the Promoter for lost, delayed or damaged data which occurs during any communication or transmission of Claims.

17. The Promoter reserves the right at its absolute discretion to disqualify Claims which it considers do not comply with these Terms and Conditions.

18. The Promoter shall have the right, where necessary, to undertake all such action as is reasonable to protect itself against fraudulent or invalid Claims including, without limitation, to require further verification as to proof of purchase, as well as the identity, age, and other relevant details of a Participant.

Privacy and Data Protection
19. Other than as set out in these Terms and Conditions or for the purposes of operating the Promotion, the details and information provided by the Participant when entering the Promotion or claiming the Reward will not be used for any promotional purpose, nor shall they be passed to any third party.
20. The Participant hereby consents to such personal information being used for this purpose and confirms they agree with the Promoter’s privacy policy available at https://recycle.exertis.co.uk/privacy-policy. The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the privacy policy.

General
21. The Promoter shall not be liable for any interruption to the Promotion whether due to force majeure or other factors beyond the Promoter’s control.
22. The Promoter reserves the right, acting reasonably and in accordance with all relevant legislation and codes of practice, to vary the Terms and Conditions of the Promotion.
23. The Promoter will not be responsible or liable for: (a) any failure to receive submissions due to transmission failures and other conditions beyond its reasonable control; (b) any late, lost, misrouted, or damaged transmissions or Claim or Rewards; (c) any computer or communications related malfunctions or failures; (d) any disruptions, losses or damages caused by events beyond the control of the Promoter; or (e) any printing or typographical errors in any materials associated with the Promotion.
24. Participants will be solely responsible for any and all applicable taxes and any other relevant costs or expenses which are not stated in the Terms and Conditions as being included.
25. By participating in this Promotion Participants agree, to the maximum extent permitted by applicable laws, to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the Promotion, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the Reward. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.
26. The Promotion is governed by English law.
